These terms are important for establishing a legal framework for the usage of this website and ensuring a positive experience for all our visitors and members.

These Terms and Conditions ("Terms") govern the sale of goods and digital content by [Your Business Name] ("we", "us", "our") to you ("you", "customer"). By placing an order on our website [Your Website URL], you agree to be bound by these Terms.

  • Email: britishavgeek1@gmail.com

  • Jurisdiction: These Terms are governed by the laws of England and Wales.

2. Products & Orders

2.1 Acceptance of Order

Your order constitutes an offer to purchase. A contract is formed only when we send you a Dispatch Confirmation email (for physical goods) or a Download Link (for digital content). We reserve the right to cancel orders if products are out of stock, priced incorrectly, or if we cannot obtain authorization for your payment.

2.2 Made-on-Demand (Custom) Items

Many of our physical products are made-on-demand via a third-party fulfillment service. This means they are manufactured specifically for you after you place your order.

  • No Cancellations: Once an order for a made-on-demand or custom product is submitted to our production partner, it cannot be cancelled or modified and cannot be refunded.

2.3 Digital Products

Digital products (e.g., eBooks, patterns, custom files, addons and/or presets) are available for download immediately after purchase.

  • License: You are granted a non-exclusive, non-transferable license to use the digital content for personal use only. You may not redistribute, resell, or share the files.

3. Pricing and Payment

  • Prices are displayed in [Currency, e.g., GBP/USD] and where possible, your local currency.

  • We accept payment via Card and all major card providers are accepted by our third party processing partners including PayPal

  • VAT/Tax:

    • UK Customers: Prices include VAT where applicable.

    • International Customers: You are responsible for any applicable sales taxes or VAT in your own jurisdiction if not collected at checkout (see Section 5).

4. Shipping and Delivery

4.1 Timelines

Shipping times displayed on our website are estimates only and are not guaranteed. As products are made-on-demand, please allow for production time (typically 5-10 days) plus shipping time.

4.2 Third-Party Fulfillment

We use third-party manufacturing and logistics partners globally. Your item may be shipped from a facility outside the UK (e.g., the USA, EU, or Australia) depending on stock availability and your location.

4.3 Lost Parcels

We are not liable for delays caused by shipping couriers or customs hold-ups. If a parcel is deemed lost by the courier, we will offer a replacement or refund at our discretion, subject to the courier's investigation.

5. International Orders: Import Duties and Customs

IMPORTANT: Please read this section carefully if you are outside the UK.

5.1 Importer of Record

When ordering from outside the UK, you are considered the "importer of record."

5.2 Duties and Taxes

You are solely responsible for all import duties, customs fees, local sales taxes, and handling charges that may be applied by your country’s customs authority.

  • We do not collect these fees at checkout (unless explicitly stated otherwise, e.g., for certain EU orders via IOSS).

  • We have no control over these charges and cannot predict what they may be.

5.3 Refusal to Pay Customs

If you refuse to pay the customs fees and the parcel is returned to us:

  • We will not refund the cost of the custom-made goods.

  • We will not refund the shipping costs.

  • We may charge you for any return shipping fees or destruction fees incurred.

6. Returns, Refunds, and Right to Cancel

Our refund policy complies with the UK Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, while noting specific exceptions allowed by law.

6.1 Custom and Made-on-Demand Goods

Exception to the Right to Cancel: Under UK law (and similar laws in the EU/Australia), the standard "right to cancel" (cooling-off period) does not apply to goods that are made to the consumer's specifications or clearly personalized.

  • Result: We do not offer refunds or exchanges on made-on-demand items if you simply change your mind, order the wrong size, or order the wrong color.

6.2 Digital Content

Exception to the Right to Cancel: By purchasing digital content, you expressly consent to immediate performance of the contract (i.e., immediate download).

  • Result: You acknowledge that you lose your 14-day right to cancel once the download has started. Digital products are non-refundable.

6.3 Faulty or Damaged Goods

If you receive a product that is materially flawed, damaged, or legally "not as described":

  • You must contact us at [Your Email] within 30 days of receipt.

  • You must provide photographic evidence of the defect.

  • We will provide a replacement or a full refund (including shipping) for faulty items.

7. Limitation of Liability

To the fullest extent permitted by law:

  • We are not responsible for indirect losses (e.g., loss of profit, loss of opportunity).

  • Our total liability to you for any claim arising out of your purchase shall not exceed the purchase price of the product.

  • Consumer Rights: Nothing in these Terms affects your statutory rights as a consumer under the laws of England and Wales, or mandatory consumer protections in your country of residence (e.g., Australian Consumer Law guarantees) which cannot be excluded by contract.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

  • Dispute Resolution: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  • International Consumers: If you are a consumer resident in the EU, USA, or Australia, you may still benefit from mandatory provisions of the law of your country of residence.

9. Data Protection (GDPR)

We process your personal data in accordance with our Privacy Policy. We use your data solely to fulfill your order and for legal record-keeping. We do not sell your data to third parties.
